Justification for direct award : The contract can be provided only by a particular economic operator because of an absence of competition for technical reasons
Other justification : The armoured vehicles are built following a specific design of their producer (up-armourer). The design includes a careful choice of spare parts which are compatible to the particular vehicle type (e.g. specific weight ). Based on that specific design + spare parts the up-armourer conducts the vehicle certification to VR7 or VR9 level. Once the certification is granted the up-armourer is bound to the selected spare parts from a specific supplier, therefore it is of utmost importance that the replacement of the spare parts is also done following the exact same spare parts. Usually the up-armourers are signing binding contracts with their suppliers which work both ways to ensure a lifelong supply and to prevent competition. Therefore the spare parts can only be purchased by the AV producer.
