Additional information : A contract was awarded on 28/11/2018 for Full Integrated Design Team Services for St. Finbarr Court Residential Development, Cabra, Dublin 7 RFT ID 131330 Mini Competition for the Provision of Full Integrated Design Team Services for Dublin City Council, St. Finbars Court Residential Development. The contract was awarded to Seán Harrington Architects as the Integrated Design Team Leader at a value of €654,795.00 ex VAT Since the award of the contract, there were a total of 7 modifications carried out, as justified under Article 72, 2014/24/EU. Modification 1: The contract value was tendered on the basis of a percentage of the final pre-tender construction cost estimate. The cost estimate of the project increased by approximately 12% following the application of the current Tender Price Index to the construction costs approved at Stage 1 by the Department of Housing. This is in accordance with the tendering procedures of the Mini-Competition under RFT131330. Justification: Article 72 paragraph (1)(a) & paragraph (1)(c) applies in the case of the modification approved by Order No. HCS/2283/2018. Increase of €115,776.00 ex VAT. Modification 2: Following review of the Stage 2 report by the Department of Housing, a number of unforeseen revisions were requested by the Department of Housing to the design (including but not limited to; reduction in overall built area of units and circulation). Justification: Article 72 paragraph (1)(b) & paragraph (1)(c) applies in the case of the modification approved by Order No. HCS/700/2020 Increase of €15,695.00 exVAT Modification 3: A recommendation was made that a consultant Landscape Architect be appointed to advise on street planting, soft landscaping & hard landscaping and on issues of compliance. Justification: Article 72 paragraph (1)(b) & paragraph (1)(c) applies in the case of the modification approved by Order No. HCS/1777/2020 Increase of €9,325.00 exVAT Modification 4: Stage 2 Approval was granted by the Department of Housing in April 2020 but was subject to a number of conditions, one of which was the removal of gas boilers from the design in response to developments in EU legislation with regards to Sustainability. This resulted in a significant re-design of the heating system and other relevant aspects of the design by the Design Team. Justification: Article 72 paragraph (1)(b) & paragraph (1)(c) applies in the case of the modification approved by Order No. HCS/751/2024 Increase of €23,810.00 exVAT Modification 5: The contract value was tendered on the basis of a percentage of the final pre-tender construction cost estimate. The pre-tender construction cost estimate was finalised following the completion of the Pre-Tender Cost Report. This is in accordance with the tendering procedures of the Mini-Competition under RFT131330. Justification: Article 72 paragraph (1)(a) & paragraph (1)(c) applies in the case of the modification approved by Order No. HCS/475/2023 Increase of €196,548.39 exVAT Modification 6: During 2022, a risk review of projects was conducted in light of contractual issues that have caused delays and/or additional costs on recent construction contracts. This review followed a number of Capital Works Management Framework Project Reviews on Completion and it was decided that the OGP Scope of Services on which the tender was based necessitated engagement of additional services, in order to mitigate known risks of additional costs and delays during construction. Justification: Article 72 paragraph (1)(b) & paragraph (1)(c) applies in the case of the modification approved by Order No. HCS/475/2023 Increase of €241,965.00 exVAT Modification 7: Order of the Assistant Chief Executive No. HCS/474/2023 approved the acceptance of the tender of Townlink Construction Ltd. for the construction of 46no. housing units and a community space at St Finbar’s Court, Cabra, Dublin 7 with a construction period of 18months. The construction period has been prolonged by 5 months and as a result, it is necessary to provide for the continued services of the Design Team. A proposal for continued services was requested from the Design Team Leader based on Scheduled Time Charges in line with Clause 11 of the Conditions of Engagement (CoE1). Justification: Article 72 paragraph (1)(a), paragraph (1)(b) & paragraph (1)(c) applies in the case of the modification approved by Order No. HCS/280/2025 Increase of €113,284.88 exVAT Dublin City Council confirm that no one modification exceeded 50% value of the original cost.
