Supplier Qualification System for Geophysical Survey Services
Baltic Sea and North Sea
50Hertz and Elia intend to establish a Supplier Qualification System (“SQS”) for the procurement of Offshore Geophysical Site Investigations.
The EMPLOYER is looking for the execution of geophysical route surveys, including data processing and reporting, for projects in the Baltic Sea and North Sea.
The services in question include the following geophysical investigation methods:
- High resolution bathymetry acquired with multibeam echosounder (MBES) equipment
- Sea bottom imagery acquired with side-scan sonar (SSS) equipment
- Sub-Bottom Profiler (SBP)
- Magnetometric survey data (MAG) acquired with u/w magnetometer detection equipment
- Magnetometric survey data (UXO) acquired with u/w gradiometer detection equipment
- Reflection Seismic Survey (UHR) for OSS surveys only
- 3-D Modell (for OSS surveys only)
- Data processing and reporting
The CONTRACTOR shall conduct state-of-the-art geophysical offshore surveys
The CONTRACTOR shall mobilise and demobilise all necessary vessels and equipment to execute the Works
The CONTRACTOR shall perform all engineering and design activities necessary to prepare the Works, vessels and equipment in order to demonstrate a safe and highly-qualitative execution of the Works.
The CONTRACTOR shall plan and execute the Works in order to comply with the EMPLOYER tech-nical specifications defined in this document.
The CONTRACTOR shall summarise all results for the surveyed corridor in a detailed geophysical report. This report shall be provided by the CONTRACTOR in the English and German languages and shall include all necessary details, calculations and conclusions. Review cycles and final acceptance shall be based on the English version. Following final acceptance, the German version of the report shall be submitted.
Section III: Legal, economic, financial and technical information
(1) The applicant confirms that he is able to communication in English language (verbally and written) on advanced level (C1) minimum.
(2) The applicant provides References for each identified environment (Baltic Sea and North Sea) of geophysical surveys (as described in section II.2.4) during the last 5 years in same type of environment:
a) 3 references for Open Sea (Depth >= 10m)
b) 3 references for Ultra Shallow Water (Depth <= 3m)
c) 2 references for Unexploded Ordnance (UXO) surveys
(3) The applicant provides information on (potential) subcontracting:
- List the activities that applicant intends to subcontract and their estimated percentage of the global activity
- List of intended subcontractors for each activity and statement for how long the business relationship has already existed

Section IV: Procedure
Section VI: Complementary information
This procedure is a Qualification Procedure. The Employer will evaluate incoming applications latest at the end of each quarter.
The outcome of this procedure is a pool of qualified suppliers.
The Employer reserves the right to update any document for qualification, especially HSE documents. The interested party will need to take the updated document into consideration and base the application and bid on it.
When the Employer has a specific project demand, the RFQ will be sent to the qualified suppliers. With this RFQ the awarding criteria and project specific requirements will be announced.
The suppliers will quote based on these RFQs.
The Employer will reduce the amount of bidders invited to negotiations to 3 - 5 bidders according to the Awarding Criteria.

Interested companies can contact the contracting authority with questions via the ARIBA platform. If the questions or answers are of general interest, they will be made available in anonymized form via the message function of the ARIBA platform. All interested companies or applicants are obliged to take the questions and answers into account when drafting their application. Non-compliance may lead to exclusion from the procedure.

The Employer assumes no responsibility for any problems with the Ariba platform.

General explanations of the contents of the request for participation:
- The Employer reserves the right to request the last audited annual report or a financial statement (not older than 6 months) available from the applicant.
- Bidding consortia: Together with the request to participate, these must submit a joint bidder declaration signed in a legally binding manner by all members and completed in full.
Particular attention must be paid to the aspect of compliance of the formation of the bidding consortium with antitrust law. Each member of the bidding consortium must submit the declarations and evidence required under items III.1.1) and II.1.2). This applies to a limited extent to the declarations and evidence under III.1.3) if the joint bidding arrangement provides for a division of tasks and, in this respect, e.g. certain references can only be submitted by one member of the joint bidding arrangement; any limited submission of declarations and evidence must be explained exhaustively by the joint bidding arrangement in an annex to the joint bidding arrangement declaration. In all other respects, the same rules apply to joint applicants as to applicants.
- Other companies: Applicants may use other companies to prove their suitability (suitability loan).
In this case, the other company must submit a declaration of commitment stating that it will provide a specifically defined partial service for the applicant in the event of an order. Both companies which lend suitability to the applicant (suitability lender and subcontractor) and - insofar as such information is already possible with the application - such other companies which the applicant would otherwise like to provide for the performance of the service (subcontractor) shall be summarized in a list where the name and registered office of the other company as well as the part of the service for which the other company is intended is formulated.

Precise information on deadlines for lodging appeals:
Deadlines for filing an application for review are derived from Section 160 (3) of the ARC.
For clarification, this provision is reproduced in full.
"The application shall be inadmissible insofar as 1. the applicant has recognized the asserted violation of procurement regulations prior to filing the application for review and has not notified the contracting entity within a period of ten calendar days; the expiry of the period pursuant to Section 134 (2) ARC shall remain unaffected, 2. violations of procurement regulations which are recognizable on the basis of the notice are not notified to the contracting entity at the latest by the expiry of the period for application or submission of bids specified in the notice, 3. the applicant has not notified the contracting entity of the alleged violation of procurement regulations prior to filing the application for review. 3. violations of procurement regulations, which are only recognizable in the award documents, are not notified to the contracting entity at the latest by the expiry of the deadline for application or submission of bids, 4. more than 15 calendar days have elapsed after receipt of the notification of the contracting entity that it does not intend to remedy a complaint.
