2.1.4 General information

Additional information : Procurement will follow open procedure. Consultants shall submit as part of their proposal information essential to evaluate the Consultant’s qualification subject to the terms and conditions of the Request for Proposal (RFP). The RFP is available from the Procuring Entity as described above. Only proposals submitted in the format of a RFP shall be accepted for further technical evaluation; any other proposals shall be rejected. The RFP will be issued only to Consultants who directly contact the Procuring Entity through the address above. All clarifications and any amendments or addenda will be communicated in writing with all Consultants who have properly obtained the RFP. The Procuring Entity shall undertake the evaluation of proposals in accordance with the terms of the RFP. The Procuring Entity shall award the Contract to the Consultant passing qualification criteria and achieving the highest combined technical and financial score. The contract will be financed with the proceeds of a loan from the European Investment Bank (“the Bank” or the “EIB”) and a grant from the Western Balkans Investment Framework (WBIF). The Bank shall not provide or otherwise make funds available, directly or indirectly, to or for the benefit of an individual or entity that is subject to financial sanctions imposed by the EU,UN, US and/or UK either autonomously or pursuant to the financial sanctions decided by the United Nations Security Council on the basis of Article 41 of the UN Charter and EU sanctions giving effect to UN Security Council resolutions that impose sanctions. Consultants originating from all countries of the world are eligible to tender. However, Consultants shall not be in conflict of interest or have been declared ineligible by the Bank. The applicable law is the law of BiH. The applicable procurement rules are the EIB’s Guide to Procurement (GtP) which can be downloaded at: https://www.eib.org/attachments/strategies/guide_to_procurement_en.pdf The EIB Anti Fraud Policy and EIB Exclusion Policy apply. Consultants must complete and sign a Covenant of Integrity as part of their proposal. Additional information : All costs related to participation in this procurement procedure shall be borne by Consultants. Consultants should alert the Procuring Entity, with a copy to the European Investment Bank to procurementcomplaints@eib.org , in case they should consider that certain clauses or provisions of this notice might limit international competition or introduce an unfair advantage to some candidates. Any Consultant who is not satisfied with the Client’s debriefing has the right to file a Complaint to the independent Complaints Committee at the address: Independent Complaints Committee appointed by Federal Ministry of Transport and Communications. 5.1.9 Selection criteria

Criterion : Average yearly manpower
Description : The minimum total permanent staff number, employed by the consultant in the field of transport (design, supervision, other support services) must be at 50 (fifty) for the last three (3) years preceding the submission deadline. In case of a JV, the minimum permanent staff of the lead partner, in the field related to this contract, must be at least 35 (thirty-five) for last three (3) years. The resources of any proposed sub-consultancy shall not be included in the evaluation.
Criterion : Average yearly turnover
Description : The Consultant must meet the following criteria: a) The average annual turnover must be at least 2,7 million EUR for the last 3 financial years (2021, 2022 and 2023). b) Positive financial results in the last three years (2021, 2022 and 2023), which shall be assessed as follows: (i) net worth shall be positive in each year; and (ii) liquidity ratio shall be more than 1 (one) in each Year. The above selection criteria will be applied to all consultants. In the case of proposals submitted by a joint venture (JV), the Leading Company shall meet not less than 60% and each partner shall meet not less than 40% of the qualifying financial criterion (a) given above. Individual partners must each satisfy the requirements for soundness of financial position as required in criteria (b). The economic and financial record of any proposed sub-consultancy shall not be included in the evaluation.
Criterion : Relevant educational and professional qualifications
Description : The Consultants must meet the following criteria: i. The consultant has implemented and completed, during the last five (5) years counting from the deadline of submission of proposals indicated below, at least two (2) major consulting engineering contracts involving construction supervision on a major motorway/expressway project implemented under FIDIC Conditions of Contract (or equivalent), with consultancy services of a minimum value of EUR 3,7 million each. The consultant shall demonstrate that it had a participation of minimum 50% in each of the contracts brought as reference; ii. Of the contracts brought as reference above, at least one shall have been delivered in any of EU Countries (Croatia, Slovenia), or EU Candidate Countries (Albania, Republic of North Macedonia, Montenegro, Serbia, Bosnia and Herzegovina, Turkey), or Potential Candidate Countries (Kosovo). The experience record of any proposed sub-consultancy shall not be included in the evaluation. Consultants are encouraged to include all prior experience (up to a maximum ceiling of 15 references) meeting the criteria above; however, only within the past five (5) years.

Conditions relating to the performance of the contract : The role of the Consultant is to act as Supervisor of construction works in accordance with the laws of the Federation of BiH relevant to the supervision. In addition, Consultant`s obligation is to take over a role of Engineer in accordance with terms of FIDIC Conditions of Contract for Construction works, Designed by the Client, Red book FIDIC, First Edition 1999. The selected Consultant will be registered for performing of the respective activity and possessing all necessary licenses of the Federal Ministry of Physical Planning. Any delays caused in the issuance of the licence(s) which are beyond the control of the Consultant cannot be a reason for annulment of contract and the Client will not impose any damage or penalties to Consultant. Possession of licenses is not a condition for participation in this procedure.
