Description : This procurement procedure regards a contract for P3 - Main Exhibition Contractor for the new Museum Galleries at the Natural History Museum of Denmark ("NHMD"). It concerns the the design, production, engineering and on-site installation of setwork (including scenography), furniture, graphic detailing, graphic production (for non-showcases), setwork lighting, tactile interactives, mounts (not in showcases) to the Ocean Hall and the Underground Galleries. In addition, the main exhibition contractor will be the main responsible for coordination with other specialist contractors, e.g. the contractors responsible for delivering specialist setworks, media content and AV Hardware to the NHMD. Justification for the accelerated procedure :
Main features of the procedure : The procurement procedure will be carried out as a negotiated procedure with prior call for competition pursuant to section 61-66 of the Danish Public Procurement Act. The procurement procedure will be carried out in two phases: • The prequalification phase • The tender and negotiation phase Only candidates who have been selected by the NHMD during the prequalification phase will be invited to submit an initial tender in the tender and negotiation phase. The NHMD intends to select three to five candidates who will be invited to participate in the tender and negotiation phase. If three candidates or less apply for prequalification the NHMD intends to select all candidates, provided that each candidate fulfils the requirements for suitability and is not subject to grounds for exclusion. However, the NHMD may choose to annul the procurement procedure if the number of candidates that fulfils the requirements for suitability and are not subject to grounds for exclusion is deemed too low to ensure an adequate competition. If more than three candidates fulfil the requirements for suitability and are not subject to grounds for exclusion, the NHMD will select three to five candidates to receive an invitation to submit an initial tender among these candidates. The NHMD expects to only select three candidates, but will select four or five candidates, if the NHMD assesses that the selection of the additional candidate(s) will significantly improve the competitive field. This selection will be based on the objective criterion "The most relevant experience". The NHMD expects the tender and negotiation phase to comprise of one round of negotiations, but the NHMD reserves the right to conduct one or more additional round(s) of negotiations. Furthermore, the NHMD reserves the right to award the contract based on the initial tender. The NHMD will award the contract to the most economically advantageous tender based on the criteria ‘best price-quality ratio’. The NHMD invites all tenderers to a site visit at the Natural History Museum of Denmark, cf. section 5.3 of the tender conditions. Candidates are excluded from participating in the procurement procedure if they are subject to one or more of the grounds for exclusion in sections 134(a) and 135-136 of the Danish Public Procurement Act. Furthermore, candidates are excluded from participating in the procurement procedure if the candidate (including other participants in an association, consortium or similar) is covered by article 5k of Regulation (EU) No 833/2014. To document that the tenderer is not subject to grounds for exclusion stipulated in sections 135-136 of the Danish Public Procurement Act, the NHMD expects to ask the tenderer to submit: • An extract from the relevant register or a similar document issued by a competent judicial or administrative authority stating that the tenderer is not subject to the grounds for exclusion stipulated in section 135(1). • A certificate issued by the competent authority in the country referred to as documentation that the tenderer is not subject to the grounds for exclusion stipulated in the cases stated in section 135(3). To document that the tenderer fulfils the requirements for suitability for participation in this procurement procedure the NHMD expects to ask the tenderer to submit: • An audited annual report or equivalent documentation stating the tenderer’s turnover, equity and equity ratio. If an annual report is not required under the law of the country in which the tenderer is established or if the tenderer’s annual report doesn’t contain the required information the NHMD will accept a signed declaration from the tenderer’s external accountant as equivalent documentation. • Documentation of the number of employees at the deadline for submission of the prequalification application, e.g., a signed declaration from the candidate’s external accountant. • Contact information (email and telephone number) to contact persons at the costumers mentioned as references in ESPD (or an appendix to the ESPD) if such contact information is not included in the ESPD (or an appendix to the ESPD). The NHMD intends to request the documentation regarding the information provided in ESPD from the selected candidates (tenderers) in connection with the invitation to submit initial tenders. The candidate is encouraged to describe its references in detail and to point out any factors that make the individual references particularly comparable to the subject of this procurement procedure. The NHMD defines “completed projects” as projects where hand over has been completed before the prequalification application deadline. The candidate’s references must fulfil the following requirements: 1) At least three of the candidate’s references must each regard a capital project of a similar nature from a comparable institution (i.e. design, engineering, production, and installation of specialist setwork in a large complex gallery environment containing museum objects/specimens), and in which the final contract sum was equivalent of at least DKK 25 million. At least one of these references must regard a permanent exhibition. 2) At least one of the candidate’s references must regard design layout (artwork), engineering, production, and installation of graphics, for which the candidate’s fee was equivalent of at least DKK 1 million for these specific works. 3) At least one of the candidate’s references must regard design, engineering, production, and installation of interactive exhibits, for which the candidate’s fee was equivalent of at least DKK 1 million for these specific works. The latter two requirements may be fulfilled using one or more of the same references as used to fulfil the first requirement if the reference fulfils all requirements. The overall assessment includes, but is not limited to, an evaluation of the following elements: • To what extent the offered project organisation is specifically suited for the content and scope of the contract, including to what extent the tender demonstrates an organisation that enables a nimble and flexible response whilst working under pressure to deliver such a complex project. • To what extent the key members of the proposed team demonstrates solid design and technical competences and experiences relevant for the delivery of specialist setwork, including scenography, furniture, graphics, lighting, tactile interactives and mounts not in showcases, in a complex environment, including expert skills to maintain climate control, meeting fire codes, using complex materiality and completing complex on-site installation processes and complying to local health and safety legislation. • To what extent the resource plan is realistic, robust and ensures that the adequate resources are allocated in each stage of the project. When evaluating the ‘Project Execution and Technical Solution’ sub-criterion, the NHMD will, in an overall assessment of the information provided by the tenderer, evaluate to what extent the tender renders it probable that the tenderer will ensure a timely handover of specialist setwork (including scenography), furniture, graphic detailing, graphic production (for non-showcases), setwork lighting, tactile interactives and mounts (not in showcases), with high manufacturing and finish quality suitable to create a great visitor experience and clearly manifest the visions and goals for the galleries and collections. The overall assessment includes, but is not limited to, an evaluation of the following elements: • To what extent the tenderer’s time schedule is realistic, robust, indicates the critical path and clearly ensures that the milestones in section 12.1.2 of the Draft Contract are met. • To what extent the tenderer through its overall and concrete approach to each of the stages, its project management plan and its solutions to the technical challenges displays a solid understanding of the project scope and complexities, supporting that the tenderer has the ability to see the specialist setwork project through design, engineering, production, installation and to handover, ensuring an appropriate involvement of the NHMD, relevant coordination with the other specialist contractors as well as timely and contractual deliveries throughout the entire project. • To what extent the proposed quality management plan ensures a proper preparation, design, and execution, so that professional errors are prevented, and that deficiencies are remedied before handover ensuring that the end-products conforms with the requirements in the procurement documents. • To what extent the tenderer illustrates the ability to design, engineer, produce and install specialist setwork, including scenography, furniture, graphics, lighting, tac-tile interactives and mounts not in showcases, of the highest possible quality, ensuring a suitable and robust solution which deliver long term protection for the museum collection, a high functionality and low maintenance. Only tenders which are awarded a score of at least 5 points for the “Project Execution and Technical Solution” sub-criterion are eligible to be awarded the contract. This implies that tenders which do not meet this minimum requirement are excluded from the evaluation and are not taken into account when the contract is awarded.

Description : Evaluation of the ‘Sustainability’ sub-criterion will be based on the information provided by the tenderer, cf. the listing in section 5.4.3 of the Tender Conditions. When evaluating the ‘Sustainability’ sub-criterion, the NHMD will, in an overall assessment of the information provided by the tenderer, evaluate to what extent the tenderer renders it probable that the tenderer to as a high degree as possible will deliver a solution which is sustainable in the long term in every area possible from supply chain to material sources and all other feasible aspects. Only tenders which are awarded a score of at least 5 points for the “Sustainability” sub-criterion are eligible to be awarded the contract. This implies that tenders which do not meet this minimum requirement are excluded from the evaluation and are not taken into account when the contract is awarded.

Information about review deadlines : The Danish Complaints Board for Public Procurement Act (Act no. 593 of 02.06.2016 which is available at www.retsinformation.dk.) contain the regulation governing the deadlines for review procedures regarding public procurement under Danish law. Complaints concerning a candidate not being prequalified must be lodged with the Danish Complaints Board for Public Procurement ("the Complaints Board") within a 20 calendar day deadline starting the day after the day that the NHMD has sent notification to the candidates involved regarding the NHMD's selection decision, cf. section 7(1) of the Danish Complaints Board for Public Procurement Act. Other complaints must be lodged with the Complaints Board within a 45 calendar day deadline initiated by the NHMD's publication of a contract award notice in the Official Journal of the European Union. The first day of the deadline is the day following the publication date, cf. section 7(2)(i) of the Danish Complaints Board for Public Procurement Act. The complainant must notify the NHMD of the complaint in writing at the latest at the same time as the complainant lodges the complaint with the Complaints Board. Furthermore, the complainant must inform the NHMD as to whether or not the complaint has been lodged in the standstill-period and whether the complainant has requested the complaint to be given suspensory effect, cf. section 6(4) of the Danish Complaints Board for Public Procurement Act. To lodge a complaint with the Danish Complaints Board for Public Procurement the complainant must pay a fee of DKK 20,000.
