HRA receives organic waste from households and organic waste from private companies, mainly from stores, shopping centre and from food industries. HRA Biogas plant is approved for treatment of organic waste Cat 3, according to waste directive 1069/2009 “regulation for animal biproducts”. The scope for the procurement is expansion of existing plant for organic waste pre-treatment and reject treatment plant. The value of the procurement is estimated above the EEA threshold. The volume is an estimate and is not binding on the contracting authority. In accordance with the regulations §7-9 (4), this acquisition is considered to provide a clearly better climate and environmental effect by having climate and environmental requirements in the requirements specification. This is justified by the fact that the acquisition is an expansion of the facility with the aim of reducing the loss of organic material. This reduces the amount of rejects delivered for combustion, and contributes to increased production of biogas that replaces fossil fuel. It is therefore our assessment that using this requirement will give a clearly better climate effect than using climate and environmental considerations as an award criterion, cf. FOA §7-9, fourth paragraph. The contracting authority reserves the right to cancel the competition, in connection with budgetary coverage and the board's approval. Main features of the procedure : About the request for participation and qualification phase (STEP 1): The competition is conducted in accordance with the Public Procurement Act of 17th June 2016 No. 73 (LOA) with the corresponding regulation of 12th August 2016 No. 974 (FOA), and the provisions contained therein the tender documents. The competition is conducted as TED - Competitive procedure with negotiation after Part I and III of the Regulation. Through this procedure, all interested suppliers can provide a request to participate in the competition. Based on the qualification requirements in section 1.3, qualified providers will be invited to submit offer. About the offer phase (STEP 2): There may be an initial reduction of the number of offers before the negotiations based on the award criteria stated in section 2, with the weighting stated there. A reduction in the number of offers can also be implemented during the negotiations. Negotiations will only be conducted if the contracting authority, after the offers have been received, considers it expedient. The supplier must therefore submit its best offer, and cannot expect to be invited to negotiations. It will be possible to negotiate all aspects of the offer with a summary of the negotiations. A revised offer must be submitted in writing. The Contracting authority intends to conduct the negotiations in week 10 and 11. The Contracting Authority has deemed that the exceptions pursuant to section 13-2 a, c and d of the Regulations apply for this procurement.
