This European tendering procedure will be conducted as a negotiated procedure with prior notice pursuant to the Dutch Defence and Security Procurement Act (ADV), which law implements the European Union public procurement directive in the field of Defence and Security (Directive 2009/81/EC). A maximum of 5 Candidates that meet the requirements set out in Chapter 2 and the selection criteria set out in Chapter 3 will proceed to the next stage being the negotiation stage. If the number of Candidates falls short of expectations, the Contracting Authority has the right to proceed to the next stage with fewer selected Candidates. The European tendering procedure is divided into three stages: the selection stage, the negotiation stage and award stage. During the negotiation stage, you have the option of submitting an initial offer. You can subsequently negotiate in the next stage about certain aspects with the Contracting Authority, which have been defined beforehand. After conclusion of the negotiation stage, you may revise your offer and then submit a final offer.

If you want to appeal against the selection decision, you must institute preliminary relief proceedings (“kort geding procedure”) within 15 calendar days of the notification of the selection decision. This can be evidenced by sending a copy of the writ of summons to the contact for this tendering procedure. In that case, the Contracting Authority will not proceed to the next stage of the tendering procedure until the judgment in preliminary relief proceedings has been rendered. The 15-calendar-day period is strictly applied. If you do not institute preliminary relief proceedings during this period, your rights to challenge the selection decision will lapse (“vervaltermijn”). If no Candidate has instituted preliminary relief proceedings within the aforementioned period, the Contracting Authority will be at liberty to initiate the next stage of this tendering procedure by making the Award Guide available to the Selected Candidates. It should moreover be noted that the Contracting Authority is entitled to reconsider its selection decision of its own accord. The Contracting Authority can do so if it establishes any mistake or omission in this European procedure, or is of the opinion that a complaining Candidate is right without being compelled to wait for a court decision, if any. Candidates who at such time have already been invited to participate in the negotiation stage are not eligible to claim any compensation.
