Main features of the procedure : The procurement will be made in accordance with the Act from 17 June 2016 no. 73 on public procurements (the Procurement Act) and regulations 12 August 2016 no. 974 on public procurements (the procurement regulations), part I and part II after the procurement procedure, open tender contest, c.f. the procurement regulations § 5 -1 (2), letter b. The contracting authority plans to hold a dialogue through negotiations with 3-5 tenderers who submit tenders for the competition. The selection of tenderers who are invited to negotiations will be made after an evaluation of the tenders in accordance with the award criteria. The dialogue can be limited to minor clarifications of the tenders, but it can also include all sides of the tenders and other received documents or information. See DFØ ́s guidelines that the assessment will depend on a concrete assessment of what climate footprint and environmental impacts the procurement has; which climate and environmental considerations will have an effect on these; and a comparison and assessment of whether it gives better climate and environmental effect to use climate and environmental requirements in the requirement specifications instead of taking care of the considerations in the award criteria. Detecting a marginally better effect when using the requirement specifications is sufficient. The contract is for canteen services. The procurement of food and drinks is listed on DFØ ́s high-risk list1 and is listed as a prioritised procurement category in the Action Plan for increased share of climate and environmentally friendly procurements and green innovation.2 This is due to a high degree of climate and environmental impact throughout the production and use phase of the products, partly due to factors such as high water consumption and use of chemicals in agriculture, freight and transport over greater distances, as well as considerable amounts of food waste. Overall, food production is for nearly a third of global climate gas emissions.3 Both DFØ and the Environment Agency recommend focusing on two measures that have great effect, including consumption in line with the current national dietary advice and reduction of food wine.4 One can also focus on initiatives that promote sustainable and organic agriculture, as well as the use of seasonal, local raw products, as this will reduce the climate and environmental impact from production and transport. The contracting authority has assessed that such strict minimum requirements in the requirement specifications, which take care of proposed measures, will be secured than better climate and environmental effect than through the use of an award criteria. There are minimum requirements that take care of national recommendations/dietary advice; use of certified raw materials and ecological products; ban on the use of palm oil; reduction of and prioritised use of environmentally labelled consumables and packaging; the use of multi-purpose containers (to reduce packaging); requirements for handling food for waste and food waste, as well as contributions to industry statistics for food waste; waste disposal; and comprehensive environmental reports. The contracting authority believes that such minimum requirements will give a better climate and environmental effect based on several factors. Firstly, the requirement specifications themselves are absolute, whilst the criteria are relative. Setting requirements will therefore ensure that the desired climate and environmental effect is achieved. Secondly, the market dialogue shows that the market in question is mature and it will not be appropriate to evaluate the proposed minimum requirements as it will be difficult to separate the tenderers from each other. They will probably achieve a very similar score and the effect of the criteria will be settled. In addition there are requirements for labelling schemes and certified products, which the contracting authority deems particularly important for the competition and in order to achieve their own environmental goals, as a rule, price driven. When using the award criteria, 30% of the environmental requirements can therefore be weighted, the price could be decisive in the competition and therefore end up with products without a labelling scheme. The contracting authority therefore believes that using climate and environmental requirements in the requirement specifications instead of taking care of the considerations in the award criteria is in this procurement. The exclusionary provision in the procurement regulations § 7-9 (4) first period will therefore apply. The contracting authority is therefore not obliged to weight the climate and environment by 30% and can, as a starting point, only use climate and environmental requirements in the requirement specifications. The contracting authority will, however, want the environment to be included as one of the award criteria with 20% weighting. It will ensure that the environment still has a significant place in the competition (in combination with strict minimum requirements in the requirement specification), as well as that the contracting authority will have evaluated tenderers within other topics where the market appears somewhat more immature and there can be more variation in what they can offer.
