EUR per loss and 80 Mio. EUR in the annual aggregate) and an 1. additional Excess layer (30 Mio. EUR) and an 2. additional Excess layer (40 Mio. EUR). In addition there is one extra layer to cover the property risk (insured limit up to EUR 100m per claim and in the annual aggregate) according to § 17g EnWG. Additionally, following specific tender procedure to tender an insurance policy will be applied: Tender procedure (Call for Competition procedure) TenneT is a “contracting entity” subject to the Public Procurement Act 2012. The notice for this Call for Competition will be published via tender platform Mercell Source-to-Contract to the Official Journal of the European Union available at http://ted.europa.eu. The Call for Competition will be based on the negotiated procedure with prior publication, which means that initially an interested market party may apply as a Candidate. The tender will be tendered in 2 lots and candidates may apply for all 2 lots separately or for all 2 lots together. Lot 1: Primary lead insurer + Property Lead insurer (T109513) Lot 2: Primary to-follow insurer + Property to-follow insurer + 1. Excess lead insurer + 2. Excess           lead insurer + 1. Excess to-follow insurer (T109515) The tender itself is characterized by  seven phases. In the selection phase (phase 1), suppliers are selected for lot 1and/or lot 2. In phase 2 selected suppliers for lot 1 are invited to submit an initial offer. After assessing the initial tenders, all parties for lot 1, who handed in an initial offer, are allowed to proceed to the negotiation phase (phase 3) according the BIPAR principle. No further selection will take place during the negotiations. After completion of the negotiations, all parties are invited to bring out a best and final offer (BAFO) for lot 1 (phase 4). While awarding lot 1 all parties for lot 2 are invited to submit an initial offer (phase 5). After assessing the initial tenders, all parties for lot 2, who handed in an initial offer, are allowed to proceed to the negotiation phase (phase 6). Methodology of offer/BAFO-evaluation The tenders/bids will be evaluated and on the basis of the award criteria provided under section 5.1.9. of the EU announcement. The awarding criterion used in the Initial Offer Phase and the BAFO Phase is Lowest Price. The BAFO must be based on the final policy wording.  The tenderer must substantiate its initial tender based on the tender documentation including the draft policy wording by means of: ■ premium net of commission or brokerage ■ maximum share which Tenderer is able and willing to accept within her own treaty capacity (the minimum share for lot 1 must be 25%). The lowest price award criterion is used because the Offshore Liability insurance which is the subject of this tender can be seen a market standard product. Description : Applicable for Lot 1 / Lot 2: Is the applicant or bidding consortium referring to the suitability of another economic operator (3rd party) in order to meet the technical minimum criteria according to section III.1.9? Description : The awarding criterion used in the Initial Offer Phase and the BAFO Phase is Lowest Price. The BAFO must be based on the final policy wording. The lowest price award criterion is used because the Offshore Liability insurance which is the subject of this tender can be seen as a market standard product. Based on the knowledge of the contracting entity of the insurance market the contracting entity concluded that only a limited number of insurers is capable of underwriting an Offshore liability insurance of this size. Since the wording will be customised during the negotiation phase of this tender and all insurers will use the defined wording during the BAFO phase there are very little differentiators between the qualified insurers left therefore only the premium (lowest price) will be used as award criterium. TenneT holds the right to share the terms & conditions (share & premium) of the awarded leading insurer for the primary (Lot 1) with all participants of the following lots (Lot 2) but is not obliged to do so. * BIPAR: (Bureau International des Producteurs d'Assurance et de Réassurance, the European Federation of Insurance Brokers), which requires that the Leading Insurer determines the price and/or the terms. Deviations above or below by Following Insurers apply only to their respective shares. A Following Insurer determines neither the premium nor the terms for the other insurers involved.
