Justification for direct award : Extreme urgency brought about by events unforeseeable for the buyer
Other justification : The envisaged negotiated procedure will be launched with LexisNexis to have the screening software available for the period between 01 October 2024 and 30 September 2027 applying the Crisis Declaration (ARES (2023)4219630). The screening software interacts with the PEGASE IT system; the list of beneficiaries is extracted in special format compatible with the screening software. Consequently, replacing the screening software may require a lengthy, complicated process to modify the PEGASE IT system software and hardware with a high risk of interruption of the PEGASE payments chain and EU support to Palestine in this critical period. The interruption of PEGASE and EU support to Palestine may have serious consequences, taking into consideration the recent political developments, the War in Gaza and the deteriorated political, financial, and security situation in the West Bank. Such interruption may undermine the EU’s capacity and measures to stabilize the region and response to the ongoing crisis. In addition, the replacement of the screening software would require significant time to determine the screening algorithm most appropriate to the requirements of PEGASE DFS (avoid high number of false negative hits and the same time do not miss significant hits). The setup of the new algorithm is a time consuming complicated process. Taking into account the above, as well as the importance of the predictability and continuity of PEGASE DFS payments in a highly volatile context, it is thus suggested to negotiate with LexisNexis to have the screening software available for the period between 01 October 2024 and 30 September 2027 to ensure the business continuity and avoid undermine the EU efforts to address current crisis.
