Energinet’s SCADA system in the electricity transmission network is highly specialized and very extensive system. The system is a proprietary system, supplied by the supplier that owns the source code for the SCADA system. The monitoring system itself is delivered through a tendered contract and this voluntary ex ante transparency solely regards the maintenance and support agreement for the system. The SCADA system is highly specialized and very extensive and therefore cannot be replaced without a multi-year process for this, thus it is not currently possible to simply enter into an agreement for a new system with a different supplier. It is expected that the system will be put out to tender and potentially changed within the next few years. This service agreement only will be current until the potential shift from the existing system. Hence, the last two years of the agreement are solely options to be called in case of a delayed transition phase.

Information about review deadlines : Complaints regarding a candidate not being pre-qualified must be filed with The Complaints Board for Public Procurement within 20 calendar days starting the day after the contracting authority has sent notification to the candidates involved, provided that the notification includes a short account of the relevant reasons for the decision. Other complaints must be filed with The Complaints Board for Public Procurement within: 1. 45 calendar days after the contracting authority has published a contract award notice in the Official Journal of the European Union (with effect from the day following the publica-tion date); 2. 30 calendar days starting the day after the contracting authority has informed the tender-ers in question, that the contracting authority has entered into a contract based on a framework agreement through reopening of competition or a dynamic purchasing system, provided that the notification includes a short account of the relevant reasons for the decision; 3. 6 months starting the day after the contracting authority has sent notification to the candidates/tenderers involved that the contracting authority has entered into the framework agreement, provided that the notification included a short account of the relevant reasons for the decision. 4. 30 calendar days after the contracting authority has published a contract award notice in the Official Journal of the European Union which clarifies the reasons for the contract being awarded without prior publication of a contract notice (when the procedure described in section 4 of the Act on the Danish Complaints Board for Public Procurement (klagenævnsloven) has been followed). The SCADA system is highly specialized and very extensive and therefore cannot be replaced without a multi-year process for this, thus it is not currently possible to simply enter into an agreement for a new system with a different supplier. It is expected that the system will be put out to tender and potentially changed within the next few years. This service agreement only will be current until the potential shift from the existing system. Hence, the last two years of the agreement are solely options to be called in case of a delayed transition phase. Further, by having the supplier of the system as the supplier of support and maintenance for the system, Energinet is able to utilize synergy effect between the two contracts. It can therefore be concluded, that Grid Solutions Denmark is the only supplier who can fulfill the contract, as: - Only the owner of the source code can perform security patches and updates. - It is a highly specialized SCADA system developed by Grid Solutions Denmark, and thus Grid Solutions Denmark are the only specialists for this specific system. - Synergy effects can only be achieved in the partnership by using the same supplier for the delivery and maintenance of system. - The system is critical to the supply of electricity, and it is thus critically important that the supplier is familiar with the system in order to provide effective support.
