Lærdal municipality announced a new tender contest for work to deceive the conditions in Lærdalselva, on the basis of grants from NVE and Østfold Energi AS. There were two tenderers, who unfortunately significantly exceeded the budget that is available, and as a result, it was inadvertently to accept. Lærdal Elveeigarlag ("Elveigarlaget") has, as a representative of the shallowigarane, a wish to realise the work. As a result of this, Elveigarlaget has entered a saman with one of the tenderers in the former tender competition, Voll Lunde Maskin AS (saman Tilbydarane). Tenderers can offer no to carry out the relevant work on mostly changed terms in relation to those received by the municipality in the competition. The updated terms mean that the contract price will be reduced by almost 30% samanlikna with the best shed that came into the competition. The tender also comprises a real fixed price contract where the auka amounts/use of time are Tenderers ́ risk. In addition the tenderer involves payment terms which result in the liquidity load in the entire project being the top of tenderers. Meir concretely, the financing from NVE will not be paid out before the submission of the final report for the project, which means seinast 15 February 2026. This means that the municipality (or others) may have to provide liquidity in order to accrue costs after a quarter that they are incurred. In this case, Tenderers, in contrast to what was concerned for the tenderer in the tender competition, offer to await payment from NVE before payment for the work can be demanding. This financial respite of the municipality also means that the risk connected to a reduction in the licence from NVE, as follows from the tender completion, lies on the Tenderer (and not on the municipality). NVE ́s contribution means that the project has been completed by 15 November 25. It may be necessary to reduce the extent of the work in the project noko, in order to ensure completion on time. If the contract work hosts reduced, the new capacity vidare will involve an additional, proportional reduction of costs. The municipality considers that there is an exception here from the obligation to announce, cf. the public procurement regulations § 5-2, letter b when the tenderer from Tenderers proves an unusually advantageous tender at a price and other commercial conditional provisions that lie mostly under normal market prices and conditional fees. The municipality intends, based on this, to enter into a contract with Tenderers in accordance with the above mentioned.
