Name : Justification for using the Public Procurement Regulations § 7-9 (4)
Description : Oslo municipality has high ambitions to set stricter climate and environmental requirements in its procurements. From 01.01.2025, all of Oslo municipality ́s building and construction sites shall be emission free and the transport of matter shall be emission free or by using biogas technology. Transport shall then be made with the help of zero emission (i.e. battery electrical or hydrogen) or biogas technology that as a minimum fulfils euro class 6/V. In this procurement it will not be evaluated on the environment as the minimum requirements for direct emissions in each call-off, cf. the Public Procurement Regulations § 7-9. The minimum requirements in call-offs for 100% emission free site and a minimum of biogas for mass transport will have a significantly better environmental and climate effect than applying this as an award criteria in the framework agreement. When it comes to indirect emissions, it is inappropriate to lock contractors to specific materials in a general framework agreement. Absolute requirements in the call-offs will mean that the Agency for Urban Environment can follow technology development during the framework agreement period in an appropriate manner. In accordance with the call-off mechanism in point 3.15.1, it will also be possible to weight suitable environmental considerations in future mini competitions. Machines, which at the time of the notice, do not exist with emission free fuel type in the market, will have to be priced with fuel type biodiesel in the framework agreement. These machines may be subject to competition with zero emission technology in each call-off when one or several of these machines are entering the market, either as a minimum requirement for a new fuel type or an award criteria.
