Description
:
The additional spend for additional works has become necessary (Art. 89(1)(b) of Directive 2014/25/EU). The additional spend for additional works has become necessary to allow for continued operations and where the change of Contractor would have caused: (1) cross liability risks in relation to changing the contractor responsible for running the Saggart WWTP and associated pump stations, (2) significant inconvenience and disruption to Uisce Éireann operational requirements, and (3) substantial duplication of costs. The need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 89(1)(c) of Directive 2014/25/EU). The ex-gratia payments were unforseen yet urgently required because of: (1) the impact of the Covid 19 pandemic, (2) the war in Ukraine and, (3) the resulting negative market conditions. Total contract value before the modifications (value excluding VAT) €43,343,981. Total contract value after the modifications (value excluding VAT) €44,862,406
